Welcome to Write Me, Maybe. Let's get the legal stuff out of the way, so we can be ready for meaningful correspondence.
This End User License Agreement ("Agreement") is a binding contract between you ("User" or "you") and Write Me, Maybe ("we," "us," or "our"). This document governs your use of our social media platform and business service software, whether you access it via a mobile application, desktop application, or web interface. This is not a contract between you, the user, and Apple Inc. This is not a contract between you, the user, and Google LLC. Apple and Google are not parties to this Agreement and bear no responsibility for the Licensed Application or its content. Write Me Maybe, LLC is solely responsible for the application and all content therein.
We have written this agreement to be as clear and understandable as possible. Our goal is to provide you with a powerful platform for handwritten social connection, but to do that effectively, we need to establish the boundaries of our relationship. By downloading, installing, or accessing Write Me, Maybe, you agree to be bound by these terms.
We want you to use our platform to connect with others. To make that happen, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Write Me, Maybe software.
What this license is not: This is a license to use the software, not a sale of the software itself. You are renting the car; you are not buying the dealership.
To maintain a safe and functional environment for all users, there are specific limits on how you can use Write Me, Maybe. You agree that you will not:
It is important to distinguish between what belongs to us and what belongs to you.
Write Me, Maybe retains all ownership, right, title, and interest in and to the software, including all copyrights, trade secrets, trademarks, and other intellectual property rights. The "Write Me, Maybe" name, logo, and the look and feel of the application are our exclusive property.
You retain ownership of the content, data, and media you create or upload to the platform ("User Content"). However, by posting content on Write Me, Maybe, you grant us a worldwide, royalty-free license to host, display, and distribute that content as required to operate (e.g., showing your posts to your followers).
Direct Messages between users will never purposefully be shown to users outside of those in the conversation. Likewise private communities within the app will be constrained to those communities. We may use this data for training machine learning models, however our intent is to be a neutral carrier and maintain privacy.
We love hearing from you. If you provide us with suggestions, feedback, or ideas for improvements, you agree that we can use those ideas freely to improve our products without any obligation to compensate you.
The digital landscape changes quickly, and we aim to keep pace.
Apple Inc. has no maintenance or support obligation to Write Me Maybe, LLC nor the user of Write Me Maybe, LLC's applications and services.
Google LLC has no maintenance or support obligation to Write Me Maybe, LLC nor the user of Write Me Maybe, LLC's applications and services.
Your privacy is central to our operations. Our use of your data is governed by our Privacy Policy, which is incorporated into this Agreement by reference.
Write Me Maybe, LLC may offer digital "Stamps" for purchase within the application. Stamps are digital goods that provide in-app functionality and do not constitute currency, cryptocurrency, stored value, securities, or financial instruments.
Stamps:
Write Me, Maybe retains all right, title, and interest in and to the Stamps and any associated digital content.
When you purchase Stamps, you acquire a limited license to use them within the platform in accordance with this Agreement. You do not obtain any ownership interest in the Stamps.
Write Me, Maybe reserves the right, at its sole discretion, to:
Such changes may occur at any time without prior notice. Write Me, Maybe shall not be liable for any modification, suspension, or discontinuation of Stamps.
All payments for Stamps are processed by third-party payment providers, including but not limited to:
Purchases made through the Apple App Store or Google Play Store are subject to the respective platform's billing terms and policies.
Write Me, Maybe does not control and is not responsible for payment processing errors, billing disputes, platform-level refund decisions, or technical payment failures originating from third-party providers.
You agree to comply with the applicable third-party payment terms when making purchases.
All purchases of Stamps are final and non-refundable, except where required by applicable law.
For purchases made through Apple or Google platforms, refund requests must be directed to the applicable platform and will be governed by their policies.
Write Me, Maybe may change pricing for Stamps at any time. Pricing changes will not affect Stamps already credited to your account.
We reserve the right to refuse, limit, suspend, or cancel transactions if we suspect fraud, abuse, chargeback manipulation, violation of this Agreement, or other improper activity.
This license is effective until terminated by you or us.
We build our software with care, but we must be honest about the limitations of technology.
In the event of any failure of the software to conform to any applicable warranty, you may notify Apple Inc., and Apple will refund the purchase price for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Write Me Maybe, LLC.
You acknowledge that Write Me Maybe, LLC, and not Apple Inc. or Google LLC, is solely responsible for:
Apple Inc. and Google LLC bear no responsibility or liability for the application, its content, or any in-app purchases.
This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which you reside, without regard to its conflict of law principles.
If you are a consumer based in the European Union or the United Kingdom, you benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in this Agreement affects your rights as a consumer to rely on such mandatory provisions of local law.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties, including the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. You agree that you will not use the software for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.
You acknowledge and agree that Apple Inc., and Apple's subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
You acknowledge and agree that Google LLC, and Google's subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of the terms and conditions of this Agreement, Google will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
You agree to comply with all applicable third-party terms of agreement when using Write Me Maybe, including but not limited to your wireless data service agreement, internet service provider terms, and any other agreements governing your use of devices or services in connection with the application. When accessing Write Me, Maybe through the Apple App Store, your use of the application must comply with the Apple Media Services Terms and Conditions, including the Usage Rules set forth therein. When accessing Write Me, Maybe through the Google Play Store, your use of the application must comply with the Google Play Terms of Service and the Google Play Developer Program Policies. In the event of any conflict between this Agreement and the applicable platform terms, the platform terms shall prevail with respect to your use of that platform.
